Problems with some songs not going into VBR Mode

Posting some more on VBR MP3's. There are a small number of songs that refuse to go into VBR mode. I can check this with a program called Goldwave. Drap the file and it will tell you 320 at either cbr or vbr. I have a problems with some songs from the 50's and 60's. All of them are remastered versions and in stereo, but they refuse to go into VBR mode. They always wind up getting an averge bit rate off 223. When I drag the song to Goldwave it says either 256CBR or 224cbr. For some strange reason the VBR refuses to work. I checked all my settings re-ripped and no luck. Anyone know the reason for this? The Guilty Songs are The Animals "House of the Rising Sun" and Jerry Lee Lewis "Whole lot of Shakin Going on"

You're going to need to tell us what program you're using and how you have it configured.  Those who use Goldwave might want to chime in as to whether this program can determine mp3 bitrate accurately.
